Η Bwin αντιμέτωπη με τον ΦΠΑ

Σύμφωνα με υπολογισμούς, η Bwin αναμένεται να πληρώσει σχεδόν 15 εκατομμύρια ευρώ σε ΦΠΑ για το 2015, μετά τις πρόσφατες αλλαγές στην επιβολή φόρων εντός της Ε.Ε. για παροχή online υπηρεσιών (καζίνο, πόκερ, αθλητικό στοίχημα).

Από την αρχή του έτους, οι στοιχηματικές εταιρείες που παρέχουν υπηρεσίες εντός τις Ε.Ε., θα φορολογούνται σύμφωνα με την χώρα στην οποία έχουν πελάτες – παίκτες και όχι σύμφωνα με την χώρα που έχει έδρα η ίδια η εταιρεία όπως συνέβαινε έως τώρα.

Η Bwin που έχει έδρα στο Γιβραλτάρ, χώρα χωρίς ΦΠΑ, είναι αντιμέτωπη με μεγάλα ποσά ΦΠΑ ειδικά στη Γαλλία και τη Γερμανία. Εκεί, όλα τα παιχνίδια πόκερ φορολογούνται με 20%, και εφόσον παρέχεται online υπηρεσία καζίνο και πόκερ το ΦΠΑ είναι 19%. Να σημειωθεί πως από τα συνολικά έσοδα της εταιρείας το 1ο τρίμηνο του 2014, το 26% προέρχεται από την γερμανική αγορά.

Η πλειοψηφία των κρατών – μελών της Ε.Ε. εξαιρεί τον online στοιχηματισμό και γενικά τα παιχνίδια στοιχηματισμού από τον ΦΠΑ. Παρόλα αυτά χώρες όπως η Γαλλία, η Γερμανία και η Ιρλανδία αποφάσισαν να φορολογήσουν τέτοιου είδους δραστηριότητα (online στοιχηματισμό), με την κάθε χώρα να φορολογεί με διαφορετικό τρόπο. Σε αυτή την απόφαση ήδη εναντιώνονται πολλές στοιχηματικές εταιρείες.

Σε ανακοίνωση της η Bwin δήλωσε πως πριν ακόμα ληφθεί οποιοδήποτε φοροελαφρυντικό μέτρο, η εταιρεία θα έχει πληρώσει το ΦΠΑ που της αναλογεί για το 2015 με αποτέλεσμα την μείωση των εσόδων κατά 15 εκατομμύρια ευρώ (όσο και το πιθανό ΦΠΑ για το 2015). Αυτό βέβαια συμβαίνει σε ορισμένες χώρες της Ε.Ε. στις οποίες υπάρχει ακόμα αβεβαιότητα (για το ύψος του ΦΠΑ).

Στην συνέχεια εκπρόσωπος της Bwin δήλωσε πως το τοπίο, όσον αφορά το ύψος του ΦΠΑ και το που αυτό θα επιβάλλεται (μεικτά έσοδα ή κέρδη), είναι ακόμα θολό. Υπάρχουν σε αυτό το στάδιο πολλές μεταβλητές που είναι άγνωστες. Η εταιρεία δήλωσε, όσον αφορά την υποχρέωση της πληρωμής του ΦΠΑ, ότι θα πληρώσει κανονικά τα περίπου 15 εκατομμύρια ευρώ που αναλογούν.

Ο εκπρόσωπος της Bwin συνέχισε λέγοντας πως, εφόσον δεν είναι δυνατή (λόγω μειωμένων εσόδων) τέτοια πληρωμή ΦΠΑ, η εταιρεία θα αναθεωρήσει την στάση της.

Μετά την ανωτέρω ανακοίνωση, η μετοχή της εταιρείας έπεσε κατά τρεις μονάδες. Στις περισσότερες στοιχηματικές εταιρείες το ΦΠΑ θα αποτελέσει σοβαρό πλήγμα. Κάποιες εταιρείες, λίγες στον αριθμό, πιστεύουν ότι θα βοηθήσει στην ανακατανομή ρόλων – θέσεων στην στοιχηματική βιομηχανία.

Για παράδειγμα η εταιρεία Winamax, πληρώνει για χρόνια ΦΠΑ για τις online υπηρεσίες πόκερ που προσφέρει στην Γαλλία (που έχει έδρα) αλλά και σε άλλες χώρες της Ε.Ε.

Η Ολλανδία συμμαχεί με το Αλντέρνι

Η Netherlands Gaming Authority (ρυθμιστική αρχή παιγνίων στην Ολλανδία) και η Alderney Gambling Control Commision – AGCC (ρυθμιστική αρχή παιγνίων του Αλντέρνι) υπέγραψαν προσύμφωνο συνεργασίας. Η ρυθμιστική αρχή στην Ολλανδία συνεχίζει να «ανεβάζει στροφές» στις διεργασίες της, ενόψει και του αναμενόμενου νόμου περί παιγνίων της ολλανδικής αγοράς το 2016.

Με την επισημοποίηση της συμφωνίας μεταξύ των δύο ρυθμιστικών αρχών, θα μπορούν να βοηθούν η μία την άλλη σε θέματα αδειοδότησης. Επίσης θα υπάρχει ανοιχτό κανάλι επικοινωνίας και πληροφόρησης για τον στοιχηματισμό, από το Αλντέρνι προς την αγορά στοιχηματισμού στην Ολλανδία.

Το προσύμφωνο υπογράφηκε ενώ αναμένεται η εισαγωγή νόμου για τον online στοιχηματισμό. Στην Ολλανδία το νομοσχέδιο αναμένεται να περάσει το τρέχον έτος, ενώ οι πρώτες άδειες θα εκδοθούν στις αρχές του 2016. Αμέσως μετά θα υπογραφεί πιθανώς και μνημόνιο συνεργασίας μεταξύ των δύο ρυθμιστικών αρχών.

Η επικεφαλής της ολλανδικής αρχής δήλωσε πως ελπίζει θα μάθουν πολλά από την μεγάλη εμπειρία της AGCC του Αλντέρνι. Προς το παρόν στην Ολλανδία αδειοδοτούνται μόνο επίγειες στοιχηματικές εταιρείες είτε είναι καζίνο, arcade (ηλεκτρονικά παιχνίδια), λοταρίες και εταιρείες αθλητικού στοιχηματισμού. Απαιτούνται ειδικές ικανότητες για την νομοθετική και λειτουργική ρύθμιση του online στοιχηματισμού, τις  οποίες θα μάθουν, όπως δήλωσε η επικεφαλής από το Αλντέρνι και την AGCC.

Η διευθύντρια της AGCC δήλωσε πως τέτοιες συμφωνίες ενδυναμώνουν την επίβλεψη στην βιομηχανία στοιχηματισμού και θα οδηγήσουν σε υψηλά επίπεδα συνεργασίας μεταξύ των εθνικών ρυθμιστικών αρχών.

Συνέχισε λέγοντας πως αυτές οι συνεργασίες παρουσιάζουν μεγάλα οφέλη για όλες τις εμπλεκόμενες πλευρές, ακόμα και για τις στοιχηματικές εταιρείες του Αλντέρνι, που θα αποκτήσουν πρόσβαση σε τόσο σημαντικές αγορές (όπως η Ολλανδία).

Η Σιγκαπούρη απαγορεύει τον online στοιχηματισμό

Ο Υπουργός Εσωτερικών της Σιγκαπούρης ανακοίνωσε την εφαρμογή νομοσχεδίου, το οποίο θα απαγορεύει τις περισσότερες μορφές online στοιχηματισμού από αυτή την εβδομάδα.

Το Remote Gambling Act, υπερψηφίστηκε από τη Βουλή της ασιατικής χώρας στις 7 Οκτώβρη και θα αρχίσει να εφαρμόζεται επίσημα από σήμερα.

Ο νέος νόμος θα απαγορεύει όλα τα παιχνίδια καζίνο και πόκερ και θα επιτρέπει μόνο περιορισμένες μορφές online αθλητικού στοιχήματος, το οποίο θα παρέχουν μη κερδοσκοπικές εταιρείες που βρίσκονται στη Σιγκαπούρη. Αυτές οι εταιρείες θα συνεισφέρουν από τα έσοδα σε κοινωνικούς σκοπούς της αυτόνομης πόλης-κράτους.

Όπως δήλωσε ο Υπουργός Εσωτερικών, προχώρησαν στη δημιουργία νόμου για τον online στοιχηματισμό, με σκοπό να διατηρήσουν τον νόμο και την τάξη, και να ελαχιστοποιήσουν τους πιθανούς κινδύνους από τον online στοιχηματισμό, ειδικά στους νέους και σε άλλες ευαίσθητες ομάδες ανθρώπων.

Το νομοσχέδιο είχε προταθεί από τον Νοέμβριο του περασμένου έτους, όταν οι αρμόδιοι διαπίστωσαν ότι ο προηγούμενος νόμος περί παιγνίων, δεν είχε δικαιοδοσία σε θέματα online στοιχηματισμού.

Με την εφαρμογή του νέου νόμου, όλες οι ιστοσελίδες που παρέχουν ή διαφημίζουν υπηρεσίες online στοιχηματισμού, θα μπλοκαριστούν όπως επίσης και όλες οι χρηματικές συναλλαγές στην Σιγκαπούρη που σχετίζονται με τον online στοιχηματισμό.

Η Media Development Authority – MDA (ρυθμιστική αρχή παιγνίων στην Σιγκαπούρη), ξεκαθάρισε ότι τα social παιχνίδια (social betting), δεν εμπίπτουν στον νέο νόμο, καθώς είχαν εκφραστεί ανησυχίες για το αν θα εγκρινόταν ο νέος νόμος σε περίπτωση που συμπεριλαμβανόταν και το social betting.

Η MDA σε ανακοίνωσή της επανέλαβε ότι ο νόμος δεν περιλαμβάνει τα παιχνίδια, τα οποία δεν επιτρέπουν στον παίκτη να λάβει χρήματα ή άλλα ανταλλάγματα έναντι χρημάτων ως αποτέλεσμα του παιχνιδιού.

Η Πορτογαλία χάνει φόρους σύμφωνα με την RGA

Η Πορτογαλία θα χάνει περί τα 20 εκατομμύρια ευρώ με το υπάρχον φορολογικό καθεστώς του αθλητικού στοιχηματισμού. Τα αποτελέσματα αυτά προέκυψαν μετά από μελέτη της Remote Gambling Association – RGA (ο οργανισμός που αντιπροσωπεύει τις στοιχηματικές εταιρίες και τις εταιρείες δημιουργίας λογισμικού).

Η RGA ανακοίνωσε πως η Πορτογαλία θα μπορούσε να κερδίσει τουλάχιστον 20 εκατομμύρια περισσότερα έσοδα από την φορολογία αθλητικού στοιχήματος έως το 2018. Αυτό θα συμβεί αν η φορολόγηση βασίζεται στα μεικτά συνολικά έσοδα και όχι στα κέρδη από τα στοιχήματα (όπως συμβαίνει τώρα).

Η Πορτογαλία θα λάβει 17 εκατομμύρια ευρώ σε φορολογικά έσοδα έως και το 2018, ενώ θα μπορούσε να κερδίσει 37 εκατομμύρια ευρώ με την ανωτέρα μέθοδο φορολόγησης.

Η RGA ισχυρίζεται ότι, σύμφωνα με την μελέτη, οι χώρες που χρησιμοποιούν τον παραπάνω τρόπο φορολόγησης έχουν επωφεληθεί, έχοντας πιο ασφαλή συστήματα. Επίσης η Πορτογαλία με το υπάρχον σύστημα φορολόγησης, μπορεί να οδηγήσει πολλούς παίκτες σε μη αδειοδοτημένες στοιχηματικές εταιρίες (χωρίς σχετικούς νόμους ή άδειες). Αυτό θα συμβεί λόγω της έλλειψης ανταγωνιστικότητας μεταξύ των αδειοδοτημένων στοιχηματικών εταιρειών σε σχέση με άλλες χώρες που χρησιμοποιούν το σύστημα φορολόγησης βασιζόμενο στα μεικτά συνολικά έσοδα.

Σε δήλωσή της η RGA ανέφερε πως η στοιχηματική αγορά στην Πορτογαλία, με τις υπάρχουσες συνθήκες, δεν είναι καθόλου δελεαστική για παίκτες καθιστώντας δύσκολη τη μετάβασή τους από την μη αδειοδοτημένη αγορά στην νόμιμη (αδειοδοτημένη αγορά).

Έχει εξακριβωθεί εμπειρικά από άλλες χώρες, ότι το καθεστώς εισφορών που βασίζεται στο συνολικό ποσό των στοιχημάτων αποτρέπει την εξέλιξη της στοιχηματικής αγοράς. Ως αποτέλεσμα μπορεί να «απορροφηθεί» μόνο το 1/4 του συνόλου της αγοράς (σε φόρους).

Σε αντίθεση, με το ανωτέρω σύστημα φορολόγησης μπορεί να «απορροφηθεί» περισσότερο του 50% του συνόλου της αγοράς όπως συμβαίνει στην Ισπανία ή ακόμα και 80% όπως στην Δανία. Δηλαδή διπλάσιο του υπάρχοντος καθεστώτος στην Πορτογαλία.

Ο online στοιχηματισμός θα νομιμοποιηθεί στην Πορτογαλία μετά από νομοσχέδιο που κατατέθηκε τον περασμένο Ιούνιο.

Intralot seals Bit8 strategic partnership

Intralot has struck a deal in principle to form a commercial and strategic partnership with Bit8, a Malta-based gaming platform solutions provider.

The agreement, which was announced at ICE today (Wednesday) covers an exclusive, joint development and marketing approach in the international online platform market and the acquisition of a significant minority stake in Bit8.

The deal is subject to customary closing requirements, including due diligence and regulatory approval.

Bit8 has developed an online gaming platform based on proprietary artificial intelligence technology, and its customers include some of the top online casinos in the world.

Bit8’s platform is an all-inclusive sportsbook and casino platform that offers player account management, eWallet, real-time analytical tools, automated rules and a bonus engine.

“Regulation and technology convergence are driving our industry towards new models, where strong player focus will be a key element of success,” Intralot chief executive officer Antonis Kerastaris said.

“We are excited to be joining forces with Bit8, a global innovator in online customer relationship management.

“As we seamlessly integrate their platform with our own and that of our customers we will be uniquely positioned to manage player data and provide an exceptional gaming experience to customers in line with our strategy to focus on the B2C segment of the global gaming market.”

Bit8 chief executive officer Angelo Dalli added that the deal would allow his company to provide solutions in more than 50 countries worldwide.

“Our solutions and innovative technology will benefit from the years of experience and global reach of Intralot, giving us an exceptional combination of technical excellence combined with customer service expertise,” he added.

“This alliance is in line with achieving our vision of having the industry’s best online gaming platform, across multiple product and channel verticals.”

Paul Phua has prior conviction in Malaysia

Former Macau junket operator Paul Phua, accused of running an illegal World Cup gambling operation in Las Vegas, has a prior conviction in Malaysia for the same offense.

Paul Phua Wei-seng, a Malaysian native from Sarawak, was arrested in Miri in 2004 and convicted for his involvement in an illegal betting scheme during the European Championship soccer tournament, reported by independent news outfit Malaysiakini.

He was slapped with a hefty fine and left the country soon after his conviction, reportedly to Vietnam to escape people who lost money when the betting operation was going bust.

Phua was even barred from re-entering the country during the World Cup in 2008.

This adds to what has become the ongoing saga of Phua’s case, following a controversial announcement of Malaysia’s minister of home affairs Ahmad Zahid Hamidi last month that Phua was assisting the government on issues of national security.

Phua was one of eight individuals arrested in July on charges of operating an illegal FIFA World Cup betting business out of three luxury villas at Caesars Palace in Las Vegas.

Just weeks before this arrest, Phua was also among two-dozen individuals arrested in what Macau officials called the largest illegal sports betting bust on local record. US prosecutors submitted documents alleging that Phua had secured his Macau release via “under the table” payments to local police. The feds claim to have learned of these alleged bribes via instant messages sent by Phua’s 23-year-old son Darren, who was also among those arrested in Vegas.

The sum being negotiated was said to be between HKD 4m and 5m (US $515k – $645k) but Phua’s attorney David Chesnoff denied the allegations, which he said were “only cited to prejudice” his client and relied on illegally obtained evidence. Phua and his son are the only two defendants in the Vegas arrest still fighting the charges.

The man once known as “The Shot” was Macau’s top earning junket operator a decade ago, before becoming a prominent high-stakes poker player.

Bwin.party warns of €15m hit due to EU VAT; Mansion withdraws from Germany

Online gambling operator Bwin.party digital entertainment has warned investors that new European Union rules on value added tax (VAT) could cost the company an extra €15m in 2015. On Jan. 1, the EU imposed new rules regarding the application of VAT to electronically supplied services. Gambling had traditionally been exempt from VAT but that decision has now been left to individual markets.

The UK-listed Bwin.party is based in Gibraltar, where it wasn’t subject to VAT. The new point-of-consumption rules will take a 19% bite out of casino and poker revenues from countries like Germany, which is responsible for over a quarter of Bwin.party’s overall revenue. Bwin.party is one of 20 firms to have been promised a new German online sports betting license, yet those licenses have yet to be formally issued and will not resolve the illegality of the company’s German-facing casino and poker operations.

Bwin.party and GVC Holdings were believed to be among a group of operators preparing to mount a legal challenge of Germany’s imposition of the VAT. There has been some suggestion that operators might decline to pay up until their legal options run out but Bwin.party’s statement on Friday says the company “expects to file for and pay VAT in certain EU Member States.” Any company withholding the VAT would be liable for stiff financial penalties should their challenge fail.

Bwin.party might be forgiven for feeling like 2015 is ganging up on the company. In addition to the new European VAT, Bwin.party’s UK-facing business is also dealing with the new 15% point-of-consumption tax. In America, where Bwin.party’s New Jersey-facing site is the market leader but continues to operate at a loss, the company will likely bleed even more red ink if/when PokerStars finally receives the regulatory nod to open its online doors in the Garden State.

Meanwhile, another Gibraltar-licensed online gambling operator has taken a very different approach to addressing the German VAT introduction. The Playtech-powered Mansion Group announced it was yanking five of its German-facing sites – Casino.com, MansionCasino.com, LesACasino.com, Club777.com and SlotsHeaven.com – from the country effective Feb. 1. Players will still have access to free-play sites, but real-money gambling will be verboten.

Earlier this month, an unidentified Gibraltar-based online gambling site played a central role in the first conviction of a German gambler for playing blackjack with a site not authorized by German authorities. Germany officially allows only online sports betting.

Nevada suffers gambling revenue fall in 2014

Las Vegas and Nevada state both saw a decline in gambling revenue during 2014.

After four years of growth, Las Vegas encountered a 2.1% fall to US$6.37 billion (€5.62 billionn), while Nevada as a whole saw a decline of 1.1% to $11 billion.

However, the figures for Nevada’s largest industry, which were revealed by the state’s Gaming Control Board, only show part of the story as the recently-released Gaming Abstract showed Strip casinos increasing total revenue in the last fiscal year by 5% and with non-gaming spending accounting for 63.3% of the overall figure.

One bright note was that the state registered its best ever sports betting revenue of $227 million, which was a rise of 11.8% on 2013.

Gamblers wagered $3.9 billion on sports during the year, an increase of 7.7%.

Control Board senior research analyst Michael Lawton said: “Sports betting volumes have set records in five consecutive years and win totals have set records in three consecutive years. This year without a doubt, sports betting was the growth story.”

For all of 2014, Nevada collected $1.5 billion from baccarat, which was decline of 5.9% compared to 2013, while casinos won $1.06 billion on blackjack and $2.62 billion on penny slots.

In January, the state collected $43.7 million in gaming taxes based on December’s gaming revenue totals, an increase of almost 23% over a year ago. For the first seven months of the fiscal year, gaming tax collections are up 1.9%.

GTECH seals sports betting partnership with MGM Resorts

Interactive gaming software and services provider GTECH has sealed a multi-year deal to provide MGM Resorts International with sports betting technology.

The deal covers 12 MGM properties and GTECH ‘OnPremise’ mobile sports betting and casino gaming at 10 MGM properties in the US state of Nevada.

The agreement represents GTECH’s first planned sports betting and GTECH OnPremise mobile gaming deployment in the US.

“This sports betting solution will allow MGM to capitalise on a new system with a single trading management interface, which could help improve global profitability across all sales channels,” said Ludovico Calvi, GTECH’s head of betting.

Matteo Monteverdi, GTECH’s senior vice-president of iGaming and Americas Interactive, added: “These solutions will offer live mobile betting guests of MGM Resorts in Nevada for the first time.

“They will also enable MGM Resorts to connect with more players in a new and relevant way, and will enable MGM to offer more gaming without requiring more space on the gaming floor.”

Thomas Mikulich, the senior vice-president of business development at MGM Resorts International, said that GTECH had been selected for the company’s “end-to-end experience, expertise, and technological innovation”.

He added: “The GTECH OnPremise solution will ensure that our players enjoy convenient and exciting new ways to wager seamlessly across multiple gaming channels, by sports betting via mobile from anywhere within Nevada, and through mobile table games and slots on premise at 10 MGM properties, whether they’re at a sports book, slot floor, restaurant, or poolside.”

bwin.party 2015 cashflow gets hit by €15 million EU tax payment

bwin.party PLC have announced that its net revenue and cashflow will be reviewed in 2015 due to new European Union (EU) VAT rules that came into action this January.

The operator expects to pay an additional €15 million in VAT, due to recent changes EU tax regulations concerning digital business/services.

Changes to EU VAT regulations concerning digital services, has seen EU member states tax businesses on where their consumers are located. The law changes came into effect on 1 January, member states have been allowed to place the tax upon businesses offering igaming services.

bwin.party governance released the following statement regarding the imposed VAT taxes;

“Whilst substantial uncertainty remains, in the light of the new rules the board now expects to file for and pay VAT in certain EU Member States and that in 2015 total net revenue and cashflow will be reduced by approximately EUR15 million before any mitigating actions”.

It is expected that the operator will be hit hardest by VAT levies for its services in France and Germany, where corporate taxes will reach 20% on gambling verticals
